These Terms of Service ("Terms") govern your access to and use of the Cash4OEM website and your participation in our OEM headlight rebate and buyback program (collectively, the "Services"). By using the Services or submitting a claim, you agree to these Terms. If you do not agree, please do not use the Services.

1. The Program

Cash4OEM offers a program through which vehicle owners, collision professionals, and partners may submit their original equipment manufacturer (OEM) headlight assemblies and related parts for potential rebate or buyback offers. Participation begins when you submit a claim through our website and provide the requested information about yourself, your vehicle, and the part(s) involved.

2. Eligibility and Submissions

To participate, you must be at least 18 years old and provide accurate, complete, and current information. You represent that you are the rightful owner of any part you submit, that it is free of liens or claims by others, and that you have the legal right to sell or transfer it to us. You are responsible for the accuracy of all information you provide.

4. Inspection, Valuation, and Payment

Any offer we extend is contingent on our receipt and inspection of the part(s). We evaluate factors that may include, without limitation, cosmetic condition, functional condition, part authenticity, model, and market demand. If, upon inspection, a part does not match the information submitted or does not meet our standards, we may adjust or withdraw any preliminary offer at our discretion. Approved payments are issued using the method and on the timeline communicated to you, following confirmation and acceptance of the part(s).

5. Shipping

Where we provide a prepaid shipping label or shipping instructions, you agree to package and ship the part(s) as directed and within any timeframe we specify. Risk of loss and title to the part(s) transfer to Cash4OEM upon our receipt and acceptance. We are not responsible for items lost or damaged in transit prior to our receipt, except as provided by the applicable carrier.

6. Your Responsibilities

• Provide truthful and accurate information;
• Submit only parts you are legally entitled to sell or transfer;
• Not submit stolen, counterfeit, or misrepresented parts; and
• Comply with all applicable laws in connection with your use of the Services.

We reserve the right to refuse service, cancel a claim, and report suspected fraudulent or unlawful activity to the appropriate authorities.

7. Intellectual Property

All content on our website — including text, graphics, logos, and design — is owned by or licensed to Cash4OEM and is protected by applicable intellectual property laws. You may not copy, reproduce, or use our content without our prior written permission.

8. Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

9. Limitation of Liability

To the maximum extent permitted by law, Cash4OEM and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Services or participation in the program. Our total liability for any claim relating to the Services will not exceed the amount, if any, we actually paid to you for the specific part(s) at issue.

10. Indemnification

You agree to indemnify and hold harmless Cash4OEM from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your submissions, or your violation of any law or the rights of any third party.

11. Changes to the Services and Terms

We may modify, suspend, or discontinue any part of the Services, and we may update these Terms at any time. When we update these Terms, we will revise the "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Georgia.
